A Safeway customer in Portland is suing the supermarket for having to pay an extra charge on certain non-grocery items that he claimed he didn't know would be paid until he saw his invoice.

The complaint filed by the Multnomah County Circuit Court on Monday is second-class litigation against a Portland company paying a surcharge to consumers in direct reaction to a proposed 1% city tax on certain large retailers.

It accuses Safeway of unlawful trading practices and unfair enrichment for charging a 3-cent surcharge on a bottle of wine advertised for $3.33. The first lawsuit was brought against AT&T for charging a 5-cent surcharge to its wireless telephone customer.

Portland officials said that AT&T should not charge customers for the Clean Energy Surcharge because they are exempt from tax as a utility company. The city has not stated any exception for Safeway. It has confirmed that large retailers subject to tax are free to raise rates or to carry on their own surcharges which appear on receipts. We can not infer or claim that a clean energy surcharge is a consumer revenue, according to Tyler Wallace, Portland's tax division director.

PORTLAND – According to his family, the body recovered from the Willamette River in northwest Portland on Sunday afternoon is believed to be missing by the University of Portland student Owen Klinger.

The Portland Police Office announced on Monday that the body had been found at 12:57 p.m. on the 9400 blocks of Northwest St. Helens Road near St. Johns Bridge. on Sunday.

The Multnomah County Sheriff's Office River Patrol Unit recovered the corpse and transferred it to the medical examiner.

The police did not release the identity of the body or any further details, but Klinger's family made a statement Monday night that they had been contacted by the officers.

"The Portland police have notified us that they have recovered the body that we believe is our son, Owen Klinger. We deeply appreciate the tremendous effort and support that thousands of people have made over the past two weeks. We are now asking for privacy as we move forward with our healing process," according to a family statement.

Students at the University of Portland have just heard about Monday afternoon's devastating news. "It's devastating," said student Kaitlyn Gibson. "He's part of the community, so that's going to hit hard."

LINCOLN COUNTY – According to Oregon State Police, the crew recovered the body of a missing Portland school counselor.

Coast Guard teams started looking for 58-year-old Hoang Tran, Clackamas, in Whale Cove, close Depoe Bay on Sunday after learning from Tran's family and someone on the coast who reported seeing rocks. The parents of Hoang Tran said on Saturday he was on a solo sailing trip off Newport's coast, but he never went home.

Coast Guard officials Tuesday, at 10:30 a.m. They said they had recovered a man's body in the Depoe Bay area where the debris had been recovered on Sunday. OSP recognized the body as people who belong to Hoang Tran and said that it was found to be wearing a life jacket.

According to Tran's parents, Tran was a Franklin High School advisor and a well-loved volunteer in the Vietnamese community.

Two-man charged in November 2011 on the morning of a rape reported near Portland State University, only to see the charges dropped days later, have now been charged with the same assault following a new review of the evidence.

Leslie L. Thornton Jr., now 38 years old, is charged with two counts of first-degree rape, first-degree sodomy, and first-degree sexual abuse. He pleaded not guilty on Wednesday morning at Multnomah County Circuit Court.

Timothy Nathaniel Hogue, 29, was drawn into detention by the U.S. Thursday. Marshals Fugitive Task Force Reno, Nevada. He was wanted on a warrant that charged him with first-degree rape in the 2011 assault.

The indictment alleges that a woman was attacked and "unable to give consent." In 2011, court papers said that she was "physically helpless" at the time. She was 43 years old, and she didn't know her assailants, the police said.

Thornton was 30 when he was first arrested in the case and told the authorities he did not know the woman.

PORTLAND— Climate activists around the globe have been rallying this week, including in Portland, calling on world leaders and governments to take important steps to combat climate change.

Thousands of people hit the streets in Portland last Friday for a massive climate strike. Friday afternoon hundreds more rallied outside Portland City Hall, calling for immediate changes to be made by local government officials.

In two groups, demonstrators hand-delivered a petition to Mayor Ted Wheeler. The Extinction Rebellion PDX and 350 PDX petition calling on the city to set a timeline for climate action to achieve net-zero emissions by 2025 with measurable targets each year.

Organizers say that the city has not been able to reduce and eliminate carbon emissions so far. The Zenith Oil Terminal in northwest Portland, which the city recently granted permits, is one example they point to.

"We all hope to get the city's commitment that there will be no expansion of the Zenith oils terminal, and a serious plan will be made for the next five years," said climate activist Janet Weil. "Oregon is an especially beautiful and green part of our earth, and that is how we want to keep it."

The groups are now calling on the city to set a timetable for action by December 2020.
